中文摘要：我国现行政府主导的农村居民点整理模式存在缺陷,导致实践中出现了很多问题。应通过立法构建农村居民点整理制度,创新农村居民点整理机制,允许城镇建设规划区范围内的近郊农村将通过居民点整理节余的集体建设用地,在符合城镇建设规划、土地利用总体规划和年度计划的前提下自由流转,以切实维护农民和农村集体经济组织的合法权益。

外文摘要：There are some weaknesses in government-led mode of rural residential land collation,which brings about lots of problems in practice.In order to protect the legitimate rights and interests of farmers and rural collective economic organizations,we should permit the free circulation of the collective-owned construction land under some circumstances by builting the legal system of rural residential land collation and innovating the rural residential land collation mechanism.
