中文摘要：对于抄袭的约束,经历了一个从道德谴责到法律规制的过程。抄袭问题的司法解决是历史的巨大进步,但著作权司法实践在面对文学领域中的抄袭问题时却暴露了一定的局限性:片面追求法律操作的简便性,而不同程度地忽略了文学的特殊性和复杂性。因此,对著作权司法实践所凭靠的文学观念进行批判就有必要提上议事日程。

外文摘要：Constraints to the plagiarism have experienced a process from moral blame to law governance. It is a great progress for judicial settlement to the plagiarism, but it turns out to be limited in a certain for the judicial practice on copyright, i.e. pursuing the portability more on law operation, neglecting the specialization and complexity of literature to some extent. Therefore, the criticism to literature ideas which the judicial practice on copyright relies on, is necessary to be taken into the consideration.
