中文摘要：根据宅基地置换是否触及土地所有权的变动,可以将其区分为征收置换和协议置换两种形态。为了弥补宅基地置换国家立法的不足,各地地方规范性文件就置换补偿对象、补偿标准和补偿协议的签约主体等事项作出了相关规定。这些规定具有一定的针对性和实效性,但仍然存在诸多问题。征收置换补偿涵盖政府与集体经济组织、宅基地使用权人以及房屋所有权人之间三类法律关系。《土地管理法》赋予集体经济组织基于公共利益需要而行使土地回收权,这是宅基地协议置换的逻辑起点。集体经济组织作为宅基地所有权行使主体应是征收置换补偿对象;作为宅基地置换补偿对象的农民应当以具有集体经济组织成员权为限。宅基地置换补偿标准应当以被置换的宅基地和房屋面积为基准,结合考虑农户成员数量予以核定。宅基地征收置换补偿协议的签约主体应当是地方政府、集体经济组织和农户;协议置换补偿协议的签约主体以集体经济组织和农户为限。

外文摘要：The replacement of homestead,according to whether it involves the change of land ownership from collective to national,can be divided into two forms:expropriator replacement and contractual replacement.In order to make up for the deficiency of national legislation on homestead replacement,relevant provisions on replacement compensation objects,compensation standards and contract subjects of compensation agreements are outlined in local normative documents.These provisions are,to a certain degree,pertinent and effective,yet there are still in them many problems.Three types of legal relationships are involved in the expropriator replacement compensation,including that between the government and the collective economic organization,the user of the homestead,and the owner of the house.The Law of Land Administration entitles the collective economic organizations to recover the land use right for the sake of public interests.This is the logical start of the agreement on homestead replacement.The legal relationship regarding contractual replacement compensation is purely private,and in no way involves public power.
