中文摘要：依据历史背景和政策价值导向,农户资格权作为针对宅基地资源财产性利用(流转)问题而创设的新权利,在宅基地“三权分置”改革过程中应该定性为身份性权利。农户资格权在农户未转让宅基地时处于隐而不显的状态,只有在农户将宅基地使用权(利用权)转让与本集体经济组织以外的其他社会主体时,才与宅基地使用权在逻辑上同时“显现”。农户资格权作为政策语言转化为法律术语时,需要进行名称、权利性质、权利主体、权利内容等方面的考量。

外文摘要：According to its historical background and the policy value orientation,farmers’household qualification right,a new term created for the property utilization(circulation)of homestead resources,should be defined as a status right during the reform.Farmers’household qualification right is implicated when the peasant household does not transfer the homestead;only when the peasant household transfers the homestead to other social subjects rather than the collective economic organization,is it manifested logically with the right to use the homestead at the same time.As a term in policy,farmers’household qualification right should be seriously considered in terms of its name,nature,subject and content when it is transferred into a legal term.
