外文摘要：Nowadays, the characteristic of "public" is emerging in the study of the performance in public management and administration. The purpose of this paper is to take the improving of the legal quality of the administrative counterpart as one of the most important way to enhancing the performance in public management and administration in the new age of advancing administration by law across-the-board, attaching importance to the person with ability, promoting the quality education and stressing the legal quality education according to the valuable tropism of the development of administration, the humanitarianism of the harmonious society and the theory of human's full-development of Marxism. The administrative counterpart is regarded as the private party in administrative process or the opposite person for administration. It is useful not only for avoiding the absence of the visual angle of increasing performance in public management and administration, but also for the full-development of human quality and the development between people and system, people and society, government and society harmoniously.
