中文摘要：最高额抵押既具有从属性,又具有独立性。最高额抵押所担保的具体债权债务可脱离最高额抵押单独转让,同时最高额抵押权也可脱离基础关系而单独转让,但受让人应只限于最高额抵押人的债权人。

外文摘要：Maximum hypothecation is not only subordinate, but also independent. If the credit guaranteed by maximum hypothecation transfers, it can be detached from the scope of credit rights guaranteed by maximum hypothecation, and maximum hypothecation does not transfer with it. At the same time, legislation should permit maximum hypothecation to be detached from the guaranteed credits and transferring independently, in order to realize the idea of the persons related. But the maximum hypothecation should only be transferred to the guarantor s other creditors, to warrant the guarantor s other debts.
